Welcome to www.imoloo.com. This site is managed by Moloo’s Hospitality Inc. These Terms of Service (the “Agreement”) is an agreement between Moloo’s Hospitality Inc, (“Moloo’s Hospitality Inc” or “us” or “our”) and you (“User” or “you” or “your” or “customer”). This Agreement sets forth the general terms and conditions of your use of the services made available by Moloo’s Hospitality Inc. By using the Moloo’s Hospitality Inc (“Service”), you are agreeing to be bound by the following terms and conditions (“Terms of Service”). Moloo’s Hospitality Inc reserves the right to update and change these Terms of Service without notice.
You must be at least 18 years old to use our Services. In addition to being of the minimum required age to use our Services under applicable law, if you are not old enough to have authority to agree to our terms, your parent or guardian must agree to our Terms on your behalf.
In order to access and use certain sections and features of the Moloo’s Hospitality Inc Services, you must first register and create an account with Moloo’s Hospitality Inc(“User Account”).
We strongly encourage you to keep the log-in credentials of your User Account confidential, and allow such access only to people you trust – as you will be solely and fully responsible for all activities that occur under your User Account and/or User Platforms (including for any representations, warranties and undertakings made therein), whether or not specifically authorized by you, and for any damages, expenses or losses that may result from such activities.
You must provide accurate and complete information when registering your User Account and using the Moloo’s Hospitality Inc Services, to which you are the sole and exclusive rights holder. We strongly encourage you to provide your own contact and billing details, including your valid e-mail address, as we may use it to identify and determine the actual and true owner of the User Account and/or User Content (as defined below) submitted to us.
You must register for our Services using accurate data, provide your current mobile phone number, and, if you change it, update this mobile phone number using our in-app change number feature.
It is your responsibility to provide accurate, current, and complete information on the registration forms. If there is ever an abuse issue or we need to contact you, we will use the primary email address we have on your account. It is your responsibility to ensure that the contact information for your account is correct and complete at all times. If you need to verify or change your contact information, you may use the Moloo’s Hospitality Inc client area to update your contact information. Providing false contact information of any kind may result in the termination of your account.
DESCRIPTION OF SERVICE
The site is for online hotel and flight booking. It is a portal that shows people different flight and hotel offers and from the results people can make their decision with respect with what choice they want to make.
WE DO NOT SELL HOTEL AND FLIGHT PRODUCTS
The Platform is a hotel and
flight search engine that provides users with price comparisons for flight and hotels.
Moloo’s Hospitality Inc does not provide, own or control any of the flight or hotel
services and products that you can access through our Platform (the “Hotel and
Flight Products”). The Hotel or Flight Products are owned, controlled or made
available by third parties (the “Hotel and Flight Providers”), either directly
(e.g., a hotel) or through a facilitator of hotel reservations (e.g., an online
travel company). The Hotel or Flight Providers are responsible for the Hotel or
Flight Products. The booking of a Hotel or Flight Product takes place solely on
the platforms of the Hotel or Flight Provider. The Hotel or Flight Provider’s
terms and privacy policies apply to your booking, so you must agree to, and understand
those terms. Further, the terms of the hotel where you plan to stay, if
different from the Hotel Provider, will also apply to your booking, so you must
also agree to, and understand those terms. Your interaction with any Hotel or
Flight Provider accessed through our Platform is at your own risk, and Moloo’s
Hospitality Inc does not have any responsibility should anything go wrong with
your booking. Moloo’s Hospitality Inc has no control over the Hotel or Flight
Products or Hotel and Flight Providers.
Moloo’s Hospitality Inc hosts content, including prices, images and other information, made available by or obtained from Hotel or Flight Providers (“Provider Content”), as well as content provided by users, such as comments, ratings and other information (“User Content” and together with the Provider Content, the “Content”). Moloo’s Hospitality Inc is in no way responsible or liable for the accuracy, quality, completeness, reliability, timeliness or trustworthiness of the Content, and Moloo’s Hospitality Inc has no influence over the Content. In particular, we do not guarantee that Provider Content, in particular the prices reflected therein, will be updated in real time or that a particular Hotel or Flight Product will be available. As a result, the price displayed by a Hotel or Flight Provider may not correspond to that displayed on our Platform. Hotel or Flight ratings displayed on this Platform are intended as only general guidelines, and the we do not guarantee the accuracy of the ratings or of any User Content.
MOLOO’S HOSPITALITY INC BOOKING
Moloo’s Hospitality Inc offers its online hotel and flight booking service, which allows a user to make a booking through our Platform. If you opt to use Moloo’s Hospitality Inc booking, the booking will be made with the Hotel or Flight Provider named on the booking page, and Moloo’s Hospitality Inc will forward the booking information that you provide to the relevant Hotel or Flight Provider. When you make a booking through Moloo’s Hospitality Inc, our Platform acts as only a user interface, and you will only have a valid booking with a Hotel or Flight Provider if you receive written confirmation within two days from that Hotel or Flight Provider accepting your booking. The contract for the relevant booking will be made between you and the Hotel or Flight Provider. Moloo’s Hospitality Inc has no responsibility for the booking or the Hotel or Flight Product because Moloo’s Hospitality Inc has no involvement in creating the description of the Hotel or Flight Product, in defining the price and any fees, and in providing the Hotel Products that you book. If you have any issues or disputes around your booking and/or the Hotel or Flight Product, you agree to address and resolve these with the Hotel or Flight Provider and not with us.
ACCEPTABLE USE OF OUR SERVICES
Legal and Acceptable Use. You must access and use our Services only for legal, authorized, and acceptable purposes. You will not use (or assist others in using) our Services in ways that: (a) violate, misappropriate, or infringe the rights of Moloo’s Hospitality Inc, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights; (b) are illegal, obscene, defamatory, threatening, intimidating, harassing, hateful, racially, or ethnically offensive, or instigate or encourage conduct that would be illegal, or otherwise inappropriate, including promoting violent crimes; (c) involve publishing falsehoods, misrepresentations, or misleading statements; (d) impersonate someone; (e) involve sending illegal or impermissible communications such as bulk messaging, auto-messaging, auto-dialing, and the like; or (f) involve any non-personal use of our Services unless otherwise authorized by us.
Harm to Moloo’s Hospitality Inc or Our Users. You must not (or assist others to) access, use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sublicense, transfer, display, perform, or otherwise exploit our Services in impermissible or unauthorized manners, or in ways that burden, impair, or harm us, our Services, systems, our users, or others, including that you must not directly or through automated means: (a) reverse engineer, alter, modify, create derivative works from, decompile, or extract code from our Services; (b) send, store, or transmit viruses or other harmful computer code through or onto our Services; (c) gain or attempt to gain unauthorized access to our Services or systems; (d) interfere with or disrupt the integrity or performance of our Services; (e) create accounts for our Services through unauthorized or automated means; (f) collect the information of or about our users in any impermissible or unauthorized manner; (g) sell, resell, rent, or charge for our Services; or (h) distribute or make our Services available over a network where they could be used by multiple devices at the same time.
Keeping Your Account Secure. You are responsible for keeping your device and your Moloo’s Hospitality Inc account safe and secure, and you must notify us promptly of any unauthorized use or security breach of your account or our Services.
LINKS TO THIRD-PARTY SITES
Our Platform may contain hyperlinks to websites operated by parties other than Moloo’s Hospitality Inc. Such hyperlinks are provided for your reference only. We do not control such websites and are not responsible for their contents or the privacy or other practices of such websites. Further, it is up to you to take precautions to ensure that whatever links you select or software you download (whether from our Platform or other websites) is free of such items as viruses, worms, Trojan horses, defects and other items of a destructive nature. Our inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators.
Our Rights. Moloo’s Hospitality Inc does not claim ownership of the information that you submit for your Moloo’s Hospitality Inc account or through our Services. You must have the necessary rights to such information that you submit for your Moloo’s Hospitality Inc account or through our Services and the right to grant the rights and licenses in our Terms.
Moloo’s Hospitality Inc’ Rights. We own all copyrights, trademarks, domains, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our Services. You may not use our copyrights, trademarks, domains, logos, trade dress, patents, and other intellectual property rights unless you have our express permission and except in accordance with our terms and conditions.
Your License to Moloo’s Hospitality Inc. In order to operate and provide our Services, you grant Moloo’s Hospitality Inc a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, create derivative works of, display, and perform the information (including the content) that you upload, submit, store, send, or receive on or through our Services. The rights you grant in this license are for the limited purpose of operating and providing our Services
Moloo’s Hospitality Inc’ License to You. We grant you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use our Services, subject to and in accordance with our Terms. This license is for the sole purpose of enabling you to use our Services, in the manner permitted by our Terms. No licenses or rights are granted to you by implication or otherwise, except for the licenses and rights expressly granted to you.
When you submit, upload, transmit or display any data, information, media or other content in connection with your use of Moloo’s Hospitality Inc (“Your Content”), you understand and agree that:
- you will continue to own and be responsible for Your Content;
- we will not sell Your Content to any third party;
- you grant other Moloo’s Hospitality Inc users a non-exclusive licence to access and use Your Content within Moloo’s Hospitality Inc, in accordance with these Terms and Moloo’s Hospitality Inc ‘s functionalities;
- we may use the name that you submit in connection with Your Content (whether that be your account name, real name or otherwise); and
- you will comply with these Terms, including our Moloo’s Hospitality Inc Acceptable Use Policy, in your submission of Your Content.
- are allowed to retain and continue to use Your Content after you stop using Moloo’s Hospitality Inc ;
- may be required to retain or disclose Your Content: (a) in order to comply with applicable laws or regulations; (b) in order to comply with a court order, subpoena or other legal process; (c) in order to respond to a lawful request by a government authority, law enforcement agency or similar body (whether situated in your jurisdiction or elsewhere); or (d) where we believe it is reasonably necessary to comply with applicable laws or regulations, in each case whether such applicable law or regulation, legal process or government body is of your jurisdiction or elsewhere;
- may be required to retain or disclose Your Content in order to enforce these Terms or to protect any rights, property or safety of ours, our affiliate companies or other users of Moloo’s Hospitality Inc .
You understand that even if you seek to delete Your Content from Moloo’s Hospitality Inc , it may as a technical and administrative matter take some time or not be possible to achieve this – for example, we may not be able to prevent any third party from storing or using any of Your Content that you have made public via Moloo’s Hospitality Inc .
We reserve the right to block or remove Your Content for any reason, including as is in our opinion appropriate, as required by applicable laws and regulations.
RESPONSIBILITY FOR YOUR CONTENT
You are solely responsible for Your Content. We are not responsible for maintaining a backup of Your Content – we recommend that you keep a back-up copy of it at all times.
You must at all times ensure that: (a) you have the rights required to copy, process, transmit, access, publish, display and use Your Content, and to grant us and other third parties the rights as set out in these Terms; and (b) Your Content (and our use of Your Content in accordance with these Terms) does not infringe or violate any applicable laws or regulations or the rights of any person.
OUR INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights in or to Moloo’s Hospitality Inc and any Moloo’s Hospitality Inc Website (including any future updates, upgrades and new versions to all such Moloo’s Hospitality Inc Website), will continue to belong to us and our licensors. Except as expressly provided in these Terms, you have no right to use our intellectual property rights, including our trademarks or product names, logos, domain names or other distinctive brand features, without our prior written consent. Any comments or suggestions you may provide regarding Moloo’s Hospitality Inc are entirely voluntary and we will be free to use these comments and suggestions at our discretion (including using such comments to improve existing services or create new services) without any payment or other obligation to you.
We grant you a, personal, on-exclusive, non-sublicensable, non-transferrable, royalty-free and revocable right to use Moloo’s Hospitality Inc and any services from us as part of or in relation to your use of Moloo’s Hospitality Inc, solely in accordance with these Terms and subject to any other instructions as provided by us to you in relation to your use of Moloo’s Hospitality Inc from time to time. Please note that these terms may be supplemented by terms and conditions applicable to Moloo’s Hospitality Inc Website.
You may not copy, modify, create derivative works, reverse compile, reverse engineer or extract source codes from Moloo’s Hospitality Inc Website, and you may not sell, distribute, redistribute or sublicense Moloo’s Hospitality Inc or the Moloo’s Hospitality Inc Website, except in each case to the extent that we may not prohibit you from doing so under applicable laws or regulations or you have our prior written consent to do so. Where applicable laws or regulations entitle you to reverse compile or extract source codes from Moloo’s Hospitality Inc Website, you will first contact us to request the information you need.
We may from time to time provide updates to Moloo’s Hospitality Inc Website. Such updates may occur automatically or manually. We do not guarantee that we will provide any updates for any Moloo’s Hospitality Inc Website, or that such updates will continue to support your device or system. All updates to the Moloo’s Hospitality Inc Website are part of the Moloo’s Hospitality Inc Website and subject to these Terms, except as otherwise specified by us.
LIMITATION OF LIABILITY
Hospitality Inc makes no representations about the suitability of the Content
displayed on our Platform for any purpose. The display on our Platform of a
Hotel or Flight Product or any Content does not in any way imply, suggest, or
constitute a recommendation by Moloo’s Hospitality Inc of that Hotel or Flight Product
or that Content, or any sponsorship or approval of such Hotel of Flight Product
or such Content by such Hotel or Flight Provider, or any affiliation between
such Hotel or Flight Provider and Moloo’s Hospitality Inc. All Content and any
other information provided on our Platform are provided “as is” without
warranty of any kind. Moloo’s Hospitality Inc disclaims all warranties and
conditions that this Platform, its servers or any email sent from Moloo’s Hospitality
Inc are free of viruses or other harmful components. Moloo’s Hospitality Inc
hereby disclaims all warranties and conditions with regard to any Content or
any other information provided on our Platform, including all implied
warranties and conditions of merchantability, fitness for a particular
response, title and non-infringement.
The Hotel or Flight Providers are independent from Moloo’s Hospitality Inc and are not agents or employees of Moloo’s Hospitality Inc. Moloo’s Hospitality Inc is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any Hotel or Flight Provider, including for injuries, death, property damage, or other damages or expenses resulting therefrom. Moloo’s Hospitality Inc will not be liable for any cancellation, overbooking, strike, force majeure or other causes beyond its direct control. Moloo’s Hospitality Inc does not accept responsibility for the uninterrupted accessibility to our Platform and may carry out technical or maintenance work on the Platform at any of its choosing.
In no event shall Moloo’s Hospitality Inc be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use of this Platform or with the delay or inability to access, display or use this Platform (including, but not limited to, your reliance upon opinions appearing on this Platform; any computer viruses, information, software, linked sites, products and services obtaining through this Platform; or otherwise arising out of the access to, display of or use of this Platform) whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Moloo’s Hospitality Inc has been advised of the possibility of such damages.
If, despite the limitation above, Moloo’s Hospitality Inc is found liable for any loss or damage which arises out of, or in any way connected with, any of the occurrences described above, then the liability of Moloo’s Hospitality Inc will in no event exceed, in the aggregate, One-Hundred Dollars (US$100.00) or the equivalent in local currency.
The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of Moloo’s Hospitality Inc.
You use our services at your own risk and subject to the following disclaimers. We are providing our services on an “as is” basis without any express or implied warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, title, non-infringement, and freedom from computer virus or other harmful code. We do not warrant that any information provided by us is accurate, complete, or useful, that our services will be operational, error free, secure, or safe, or that our services will function without disruptions, delays, or imperfections. We do not control, and are not responsible for, controlling how or when our users use our services or the features, services, and interfaces our services provide. We are not responsible for and are not obligated to control the actions or information (including content) of our users or other third parties. You release us, our subsidiaries, affiliates, and our and their directors, officers, employees, partners, and agents (together, the “Moloo’s Hospitality Inc parties”) from any claim, complaint, cause of action, controversy, or dispute (together, “claim”) and damages, known and unknown, relating to, arising out of, or in any way connected with any such claim you have against any third parties. You waive any rights you may have or law of any jurisdiction, which says that: a general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor. Moloo’s Hospitality Inc shall not be responsible for any damages your business may suffer. Moloo’s Hospitality Inc makes no warranties of any kind, expressed or implied for services we provide. Moloo’s Hospitality Inc disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Moloo’s Hospitality Inc and its employees.
DISCLOSURE TO LAW ENFORCEMENT
Moloo’s Hospitality Inc may disclose any user information to law enforcement agencies without further consent or notification to the user upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.
AVAILABILITY OF OUR SERVICES
Our Services may be interrupted, including for maintenance, repairs, upgrades, or network or equipment failures. We may discontinue some or all of our Services, including certain features and the support for certain devices and platforms, at any time. Events beyond our control may affect our Services, such as events in nature and other force majeure events.
We may make changes to these Terms (and any applicable Additional Terms) over time (for example, to reflect technical improvements and changes to Moloo’s Hospitality Inc (for example, to address a security threat) or applicable laws and, so please come back and review these Terms regularly.
Where we consider that such changes are reasonably substantial, we will notify you via our website, direct communication to you, on this page or the relevant page for the relevant additional terms or policy, or other means), prior to such changes becoming effective. GOVERNING LAW AND JURISDICTION
The Moloo’s Hospitality Inc Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the Moloo’s Hospitality Inc Services, their interpretation, or the breach, termination or validity thereof, the relationships which result from or pursuant to the Moloo’s Hospitality Inc Terms, or any related transaction or purchase, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Canada, without respect to its conflict of laws principles.
Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by, a court of competent jurisdiction located in Canada
Subject to any applicable law, all disputes between you and Moloo’s Hospitality Inc shall only be resolved on an individual basis and you shall not have the right to bring any claim against Moloo’s Hospitality Inc as a plaintiff or a member of a class, consolidated or representative actions (or any other legal proceedings conducted by a group or by representatives on behalf of others).
If any provision of the Moloo’s Hospitality Inc Terms is deemed by a court of competent jurisdiction to be invalid, unlawful, void, or for any reason unenforceable, then such provision shall be deemed severable and will not affect the validity and enforceability of the remaining provisions. No Waiver of any breach or default of any of the Moloo’s Hospitality Inc Terms shall be deemed to be a waiver of any preceding or subsequent breach or default.
These Terms will apply to your use of Moloo’s Hospitality Inc until your access to Moloo’s Hospitality Inc is terminated by either you or us.
You may terminate your use of Moloo’s Hospitality Inc, or any of the services accessible therein, at any time (including if we have told you about an upcoming change to all or part of Moloo’s Hospitality Inc or these Terms which you do not agree to). We may suspend or terminate your access to your account or any or all of Moloo’s Hospitality Inc:
- if we undertake maintenance or support of Moloo’s Hospitality Inc ;
- to make changes to Moloo’s Hospitality Inc as notified by us to you;
- if we reasonably believe that you have breached these Terms;
- if your use of Moloo’s Hospitality Inc creates risk for us or for other users of Moloo’s Hospitality Inc , gives rise to a threat of potential third party claims against us or is potentially damaging to our reputation;
- if such suspension or termination is required due to Applicable Laws; or
- to the extent permitted by applicable laws and regulations, for any other reason in our sole and absolute discretion, and where reasonably practicable, we will give you advance notice of any suspension or termination.
